A resident of this State may make an assignment in trust for the benefit of creditors, and a non-resident may in good faith make transfer of property within the State. Notice is given creditors by publication. In insolvency proceedings all claims of persons residing in the State if not presented before final settlement among the creditors, but those residing out of the State are not affected by insolvency if they make no appearance in the insolvency proceedings.
Attachments may issue for securing any judgment that may be obtained in an action upon a contract executed or payable in this State, but defendant may give security for the payment of such judgment and thus release attachment. The plaintiff must file affidavit that the attachment is not sought to delay, hinder or defraud any other creditor, and a bond with securities for at least one-half of the claim must be filed to protect defendant should he recover judgment.
Exemptions. --A homestead consisting of land and dwelling house not exceeding in value $5000; homestead of a single person to extent of $1000 is also exempt; necessary household articles, wearing apparel and provisions for three months; farming utensils or implements of husbandry, two oxen, or two horses or two mules and their harness, one cart or wagon, and food for such oxen, etc., for one month, seed, grain or vegetables for planting or sowing not exceeding $200; seventy-five beehives, the library and instruments of professional and scientific men; tools and implements of artisans, the cabin and dwelling of a miner, not exceeding $500 in value, and necessary to instruments not exceeding in value $500, and miner's claim worked by him and not exceeding $1000 in value; all privileges growing out of any life insurance, if the annual premiums do not exceed $500.
Interest. -- Legal rate seven percent. Any rate allowable by written contract.
Limitation of Actions. -- Two Years. -- Upon all written instruments executed out of the State, on all debts or demands not founded on a writing, and against public officials.
Three Years. -- Trespass to real property, taking, detaining, or for recovery of personal property, or for relief on account of fraud or mistake.
Four Years. -- On written instruments executed in the State.
Five Years. -- For the recovery of lands for any interest therein, or for suit upon judgments.
Judgments. – A superior court judgment from the time it is docketed becomes a lien upon all real property owned by the judgment debtor in the county where the judgment is recorded. A transcript may be filed in any county, when it immediately becomes a lien upon any property that debtor may have in such county, and remains a lien for two years only. A judgment of justices' court filed with recorder also becomes a lien.
Stay of Execution. -- It's is within the power of the court to grant a stay for a reasonable time.
